Escalating Intimidation Targets Families of 2022 Protest Victims in Iran

HRANA, Human Rights Activists News Agency – Over the past month, the Iranian security and judicial institutions have intensified their crackdown on the families of victims of the 2022 nationwide protests.

They have employed various tactics, including summoning, arresting, prosecuting, and discouraging them from holding commemoration ceremonies for their deceased loved ones. Additionally, reports indicate instances of grave desecration.

Arrests and Judicial Interference

On April 20, 2023, Hossein and Mehdi Kazemi, brothers of Majid Kazemi, one of three executed convicts in the “Isfahan House” case, were reportedly arrested and subjected to physical assault at their home. Following their arrest, Majid Kazemi’s sister, Somayeh Kazemi, was also detained while inquiring about her brothers’ well-being.

Somayeh Kazemi was released on May 22, while Hossein and Mehdi Kazemi were granted bail and released on June 18.

Furthermore, on June 16, relatives of teenager Abolfazl Adinehzadeh, who was killed during the protests, were arrested in Mashhad. The arrested individuals included Abolfazl’s mother, Goldasteh Hosseini Jahanabad, his father, Ali Adienzadeh, his sister, Marzieh Adinezadeh, and his uncles, Reza and Musa Adienzadeh, who faced violent arrests. Subsequently, Ali and Reza Adinezadeh were transferred to Shirvan Prison, while Marzieh and her mother were taken to Bojnurd Prison. They were later released on bail between June 18 and June 21.

Abolfazl Adinezadeh was fatally shot by regime forces during the 2022 nationwide protests in Mashhad, reportedly sustaining 25 bullets to his chest and abdomen.

In Saqqez, several people were arrested on June 9 following a protest rally at the burial site of another teenage victim, Danial Pabandi. Among those detained were the families of several victims and the drivers of two minibuses transporting the families to the cemetery. Some of the detainees were released on bail the day after their arrest.

On June 17, 2023, Sajad Pirfalak, the uncle of Kian Pirfalak, a minor who tragically lost his life during the 2022 nationwide protests, was apprehended by security forces in Izeh. He was subsequently taken to the detention facility of the Ministry of Intelligence.

The following day, Kian Pirfalak’s mother, Mahmonir Molaie-Rad, was summoned to the Ministry of Intelligence office in Izeh.

On April 11, 2023, security forces arrested Foad Choobin in Izeh. Foad’s nephew, Artin Rahmani, was killed by regime forces during the 2022 nationwide protests in Izeh.

Grave Desecrations and Disruption of Memorial Ceremonies

Reports have surfaced concerning the desecration of several graves belonging to protest victims. Within the past month, at least four graves, including those of Majid Kazemi, Mohsen Shakari, and Sepher Azami, were destroyed or set on fire.

Ashkan Amini, the brother of Mahsa Amini, shared news of the desecration of his sister’s burial place for the second time. The Saqqez Municipality has allegedly planned to carry out reconstruction at the cemetery where Mahsa Amini is buried, seemingly as an attempt to prevent gatherings and commemoration ceremonies. In protest against these malicious actions, traders and shopkeepers in Saqqez went on a general strike on June 13, 2023, closing their shops.

Majid Kazemi’s family was reportedly prevented from holding his funeral, with heavy security presence around his grave. Kazemi’s grave was set on fire on June 7th, the day his family had planned to hold a memorial service.

Similarly, the family of Kian Pirfalek faced an intense security presence and threats during a memorial ceremony at the burial place.
The families of Mohsen Shekari and Sepehr Azami, two victims of the 2022 nationwide protests, have also reported the desecration of their loved one grave.

Majid Kazemi’s family faced impediments when attempting to hold his funeral, with heavy security presence surrounding his grave. On June 7, the day of the planned memorial service, Kazemi’s grave was set on fire.

Likewise, Kian Pirfalak’s family encountered intense security presence and threats during a memorial ceremony at his burial site.

The families of Masoud Shekari and Sepehr Azami, two victims of the 2022 nationwide protests, have also reported the desecration of their loved ones’ graves.

It is important to note that the Iranian regime and its security forces have a history of desecrating dissidents’ burial places.

Violence Against Protestors’ Families

During a ceremony held on June 11, 2023, to commemorate Kian Pirfalak’s birthday, police fatally shot a citizen. The victim, Pouya Molaie-Rad, approximately 20 years old, was the cousin of Kian Pirfalak’s mother. Multiple sources have reported multiple arrests made by the police during the ceremony.

IRNA confirmed that Molaie-Rad succumbed to his injuries while receiving treatment at the hospital.
Fars News Agency, associated with security institutions, claimed that a police officer named Mohammad Ghanbari also lost his life, allegedly after being struck by a car.

Background on the 2022 Nationwide Protests

The arrest of Mahsa Amini by Tehran Morality Police for her improper hejab and her suspicious death on September 16 sparked protests sweeping across Iran. During the nationwide protests, about 19600 people, including journalists, artists, lawyers, teachers, students and civil rights activists, were arrested.

Update on Legal Status of Death-Row Protesters Ten Months after the 2022 Nationwide Protests

Since the inception of the 2022 nationwide protests, judicial authorities have handed down death sentences to 25 protestors thus far, with 7 executions having already taken place. While the Supreme Court of Iran has upheld the death sentence for Mohammad Ghobadlou, it has overturned ten other death sentences. The remaining seven death sentences were issued by lower courts and are currently awaiting finalization.

According to Human Rights Activists News Agency (HRANA) reports, at least 25 protesters have been sentenced to death since the beginning of the 2022 protests.

Among them, Mohammad Ghobadlou’s death sentence was recently affirmed by the first branch of the Supreme Court of Iran. The death sentences of other protestors, Mansour Hout, Nezam’aldeen Hout, Ebrahim Naroui, Abbas (Mojahed) Kourkouri, Shoaib Mirbalouchzohi Rigi, Mansour Dehmorde, and Kambiz Khorout, were initially handed down by lower courts and are currently under review by the Supreme Court.

Additionally, the death sentences of Reza Arya, Hamid Ghare Hassanlou, Sahand Nourmohammadzadeh, Hossein Mohammadi, Mehdi Mohammadifard, Arshia Takdastan, Javad Rouhi, Saman Seydi (Yasin), Mahan Sadrat Marani (Madani), and Mohammad Boroughni have been overturned at various times. Their cases have been referred for review to another court branch. Some of these individuals have been sentenced to imprisonment or exile following the reversal of their death sentences, while the cases of others are still under review.

To date, 7 protesters have been executed.

Mohsen Shekari was the first to be executed on December 8, 2022. Four days later, Majid Reza Rahnavard was executed in public in Mashhad.

Mohammad Mehdi Karami and Mohammad Hosseini, two of the accused in the case known as “the murder of the Basiji Ruhollah Ajamian,” were executed on January 7, 2023.

In addition, Majid Kazemi, Saeed Yaghoubi, and Saleh Mirhashemi, three of the accused from the case known as “the Isfahan house,” were executed on May 19, 2023, in Dastgerd Prison, Isfahan.

According to reports obtained by HRANA, these 25 protesters have primarily been sentenced to death on charges of alleged “spreading corruption on earth” and “enmity against God (Moharebeh).” Many of them have been denied proper access to legal representation of their choice during the judicial process.

Some close relatives of these individuals have disclosed to HRANA that “forced confessions extracted under psychological and physical duress/torture by interrogators” have been presented as evidence during the trial.

Most of these death sentences were issued by judges such as Seyed Ali Mazloum, Seyed Mousa Assef Alhosseini, Abolghassem Salavati, Mohammadreza Amuzad, Iman Afshari, Seyed Hadi Mansouri, and Morteza Barati.

The Revolutionary Court of Tehran has issued the highest number of death sentences following the protests, with a total of 6 such sentences thus far.
The Revolutionary Court of Karaj and the Judicial Complex of Shahid Nouri (the public court of Zahedan) follow closely with 5 death sentences each.

Background on the 2022 Nationwide Protests

The arrest of 22-year-old Mahsa (Jina) Amini by morality police due to alleged “improper veiling” and her subsequent death during detention led to widespread protests in Iran. The protesters commenced the longest sustained widespread protests in the history of the Islamic Republic on September 17, 2022, with the slogan “Woman, life, freedom” and protested the laws, structure, and competency of the regime. Thousands were arrested and hundreds were killed in the crackdown on protesters by security/military forces.

UN Special Rapporteur Alarmed by Deterioration of Human Rights Condition in Iran

In his latest report, the UN Special Rapporteur on the situation of human rights in Iran, Javaid Rehman, has expressed alarm about the worsening human rights situation in the country. He highlights a range of flagrant human rights violations committed by Iranian authorities, with a focus on the events surrounding the death of Jina Mahsa Amini in September 2022.

Below is a summary of the key points from the report:

– The state authorities have failed to conduct a transparent and impartial investigation into the death of Jina Mahsa Amini. The family’s requests for an independent investigation were rejected and they were threatened and denied access to the autopsy report.

-Iranian authorities responded brutally to the protests following Jina Mahsa Amini’s death. The regime’s unlawful use of force and deliberate killings led to the deaths of at least 476 persons, including at least 64 children and 34 women.

-The Special Rapporteur is concerned about the mass arrests and detention of peaceful protesters, which have affected over 18,000 individuals including human rights defenders, students, lawyers, journalists, and civil society activists.

-The Special Rapporteur is alarmed at the continuing violence against women and girls, including cases of killings, physical and sexual abuse and fierce repression of ethnic and religious minorities, in particular the Baluch and the Kurds.

-The Special Rapporteur is outraged that, despite appeals by the international community, the Iranian authorities executed two protesters, Mohsen Shekari and Majidreza Rahnavard, in December 2022 after arbitrary, summary and sham trials, which violated the right to a fair trial and due process rights

-There have been widespread disruptions to the Internet, including blackouts and restrictions on the use of social media. The families of those killed during the protests have been harassed and intimidated, including restrictions on burials and memorial ceremonies.

-The report highlights the increase in executions, particularly of drug offenders and people from ethnic and religious minorities.

The report concludes that the investigations into the death of Jina Mahsa Amini were not credible, and there is evidence pointing to state culpability. The highest levels of the state have instigated violence and instructed the security forces to confront protesters, resulting in hundreds of deaths.

Javaid Rehman makes several recommendations to the government of Iran, including accepting responsibility for the death of Jina Mahsa Amini, releasing all those arrested and detained, ending violence, and protecting human rights defenders. The report also makes recommendations to the international community, including supporting accountability efforts, engaging with the Iranian authorities within the UN, and continuing to apply targeted sanctions for organizations and individuals that perpetrate serious violations of human rights in Iran.

58 Citizens Sentenced to Death or under the Impending Threat of Death Sentence

Dozens of Iranian people arrested at recent protests either have been sentenced to death or have faced charges such as “armed insurrection against the regime (Baghi)”, “enmity against God (Moharebeh)”, or “spreading corruption on the earth”. Charges which may result in death penalty. At the time of this writing, 2 protestors have been executed, 11 others have been sentenced to death and 47 others are facing charges that could lead to death sentences. This report provides the legal case details of 58 of these individuals.

Several arrested individuals have been accused of “leading protests” by the Judicial officials. Allegations that have resulted in charges such as Baghi, Moharebeh, and Spreading Corruption on earth.

At the time of this writing, HRANA can verify the issuance of 11 death sentences against imprisoned protestors as enlisted in this report. The other 47 people listed below are under the impending threat of death sentence.

Due to the lack of transparency in the judicial process, in many cases opened by security institutions against the protestors, the identities of some co-defendants remain undisclosed. For example, reports obtained by HRANA about a legal case over an incident during protests in the Ekbatan town of Tehran that led to the death of a Basij Militia agent, Arman Aliverdi, indicate that there are nine co-defendants. Nonetheless, HRANA has been able to identify only two of them. Similarly, in another legal case regarding protests in two neighborhoods in Isfahan that led to the death of three security forces (Col. Esmail Cheraghi, Mohammad Hossein Karimi, and two Basij Militia individuals Mohammad-Hossein Karimi and Mohsen Hamidi), HRANA could identify only 6 out of 10 co-defendants.

It is worth noting that at the time of this writing, the executions of two protestors, Mohsen Shekari and Majid-Reza Rahnavard, were carried out following an extremely quick and non-transparent judicial process, Mohsen and Majid-Reza did not even have access to chosen lawyers at their trials. Mohsen Shekari was executed in Tehran after 74 days of detention on December 8, 2022, and Majid-Reza Rahnavard was publicly executed by being hanged in Mashhad on December 12, 2022, only 23 days after his arrest.

The following enlists legal case details of 58 detainees who are either sentenced to death or at risk of receiving a death sentence.

Iran Protests: Mohsen Shekari Executed over Protests

Iran’s Judiciary announced the execution of Mohsen Shekari, one of the people arrested at recent protests, on Thursday morning, December 8, 2022.

According to HRANA, the news agency of Human Rights Activists, quoting Mizan News Agency, on December 8, 2022, Mohsen Shekari was executed in Tehran.

Shekari was arrested at protests in Sattar Khan street in Tehran.
On November 1, 2022, the Tehran Revolutionary Court sentenced Shekari to death on the charge of “enmity against God, terrorizing people, injuring a Basij Militia force with a cold weapon, and disturbing public order by blocking the street.”
